Terms of Service

These terms are the agreement between you and MOJO VIBES PTY LTD, trading as SOS CAFE & BAR, for use of this website and for pickup and dine-in orders placed on it. By placing an order or sending a message, you agree to them, together with the Privacy Policy and Returns Policy.

Orders

The menu on this site is an invitation to order. A contract is made when we accept your order, which is when the payment is completed and you see an order confirmation. We may refuse or cancel an order if an item has sold out, the kitchen is closed, we suspect fraud, or we cannot meet an allergy or timing request. If we cancel after you have paid, we will refund the payment.

You are responsible for checking the items, notes and collection time before you pay. Collection is from 4 Yarra Street, South Yarra VIC 3141. This website does not deliver.

Prices and GST

Prices are in Australian dollars and include GST. MOJO VIBES PTY LTD is registered for GST. ABN 51 675 868 158. The confirmation page is your tax invoice. The price you are charged is the price calculated on our server from the current menu, not a price stored in your browser.

Pickup and dine-in

Choose a time inside the hours published on the About page. The last online time is 30 minutes before close. Please arrive within 15 minutes of that time. If you are running late, call 03 9997 5000. Food that is ready and not collected may be discarded. A failure to collect is not, by itself, a fault in the order.

Dine-in means you are paying ahead to eat or drink at the venue. It does not reserve a particular table unless we confirm a booking separately.

Alcohol and bottomless

We are a licensed venue. Alcohol is sold under Victoria’s liquor laws and responsible service of alcohol. You must be 18 or over, and you must show photo ID if asked. We can refuse service. Ordering alcohol online does not guarantee it will be served if you cannot prove your age at the venue.

The Bottomless Bundle is dine-in only, lasts two hours from the time on the order, and must be bought with a main meal from Breakfast or Mains. It cannot be taken away, paused, or transferred. Standard drinks are still served under responsible service rules, including the right to stop service.

Allergies

Tell us about allergies in the item note and, for anything serious, call the venue before you pay. The kitchen handles common allergens. We cannot guarantee that a dish is free from traces of gluten, nuts, dairy, egg, sesame, soy or shellfish.

Acceptable use

Do not misuse the site, attempt to interfere with checkout, or send card numbers through the contact form. Card payments are only taken through PayPal on the checkout page.

Liability

Nothing in these terms excludes, restricts or modifies rights you have under the Australian Consumer Law that cannot be excluded. Where the law allows a limit, our liability for a service or good is limited to resupplying it or paying the cost of resupply, or a refund, as the Returns Policy describes.

We are not liable for loss that is caused by a delay outside our control, by incorrect details you gave us, or by your failure to collect an order that was ready.

Law

These terms are governed by the laws of Victoria, Australia. The courts of Victoria have jurisdiction.
